Contract
1. PET ONLY / BREEDING RESTRICTION
The puppy is sold strictly as a companion animal (“PET ONLY”). Buyer agrees that this dog shall not be bred under any circumstances.
Buyer further agrees to spay or neuter the dog by one (1) year of age and accepts full responsibility for preventing accidental
breeding and maintaining control of the dog at all times.
LIQUIDATED DAMAGES FOR BREACH:
If the dog is intentionally or accidentally bred in violation of this agreement, Buyer agrees to pay Seller liquidated damages in
the amount of $1,000 per puppy produced. The parties agree that Seller’s damages are difficult to calculate and that this amount
represents a reasonable estimate of loss and is not a penalty. No registration rights shall be granted retroactively.
2. VACCINATIONS & VETERINARY CARE ACKNOWLEDGMENT
Buyer acknowledges that the puppy requires continued DAPPv vaccinations at approximately 10 and 13 weeks of age and may
require additional vaccines as recommended by a licensed veterinarian. Buyer understands that rabies vaccination is legally
required in Michigan between 12–16 weeks of age and thereafter as required by law.
Buyer agrees to provide lifetime veterinary care under the supervision of a licensed veterinarian and to maintain the puppy at a
healthy weight. Failure to provide proper veterinary care or allowing the dog to become overweight will void all health guarantees.
3. MICROCHIP
Buyer acknowledges the puppy has been microchipped and agrees to complete registration transfer into Buyer’s name at Buyer’s
expense.
4. SHORT-TERM HEALTH GUARANTEE
Seller warrants that the puppy is in good health to the best of Seller’s knowledge at the time of sale. Buyer must have the puppy
examined by a licensed veterinarian within seventy-two (72) hours of transfer of ownership. Failure to do so voids this guarantee.
If a serious health issue is confirmed in writing by the veterinarian within this period and the puppy is returned immediately at
Buyer’s expense, Seller will provide a replacement puppy of equal or lesser value.
5. LONG-TERM CONGENITAL HEALTH GUARANTEE
Seller provides a two (2) year guarantee from date of birth against life-threatening congenital defects. Confirmation by two
licensed veterinarians is required, including necropsy if the puppy is deceased. Remedy is limited to replacement puppy only.
No refunds will be issued.
6. EXCLUSIONS
This guarantee does not cover parasites, coccidia, giardia, worms, kennel cough, allergies, hypoglycemia, hip dysplasia,
patellar luxation, recessed vulvas, retained testicles, malocclusions, temperament issues, injuries, abuse, neglect, or
environmental diseases.
7. FIRST RIGHT OF REFUSAL
If Buyer can no longer care for the dog, Seller shall have the first right of refusal to reclaim the dog before rehoming.
Buyer is responsible for transportation.
8. LIMITATION OF LIABILITY
Seller’s liability is limited to the original purchase price. Seller shall not be responsible for veterinary expenses, shipping,
or incidental costs.
9. GOVERNING LAW
This agreement shall be governed by the laws of the State of Michigan. Venue shall lie in Jackson County, Michigan.
